ISLANDWIDE (IWIDE) TERMS AND CONDITIONS
These Terms and Conditions ("Terms") govern the access to and/or use of the applications, websites, content, products, and services of PJ Rosaly Enterprises, LLC, doing business as Islandwide Express, and its representatives, affiliates, officers, and directors (collectively, "Islandwide").
PLEASE READ THESE TERMS CAREFULLY, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND ISLANDWIDE. In these Terms, the words "including" and "includes" mean "including, but not limited to."
By using our Services, you confirm your acceptance of these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede any prior agreements or terms with you. Islandwide may immediately terminate these Terms or any Service concerning you, or cease offering or deny access to the Services or any portion thereof, at any time and for any reason.
Supplemental terms may apply to certain Services, such as policies for the use of a specific product, service, or promotion. Supplemental terms are additional and shall be deemed part of the Terms for the applicable Services. Supplemental terms shall prevail over these Terms in the event of a conflict concerning the applicable services.
Islandwide may modify the Terms at any time. Amendments will become effective when Islandwide posts such updated Terms at this location. Your use of the Services after such posting confirms your consent to be bound by the Terms, as amended.

THE SERVICES: The Services include access to and use of web and mobile applications, pickup and delivery of goods (boxes, envelopes, packages), confirmations, and related services that allow users to organize and schedule the Services.

PACKAGING REQUIREMENTS: The maximum weight for each box, envelope, or package is 60 pounds. The maximum dimensions for each box, envelope, or package are 20" x 20" x 20" or their equivalent in cubic volume. Any dimensions or weight exceeding these limits may incur additional charges and/or may be rejected by Islandwide. Bundled packages tied together will not be accepted. Fragile items must be individually wrapped and cushioned with appropriate packaging materials (e.g., bubble wrap, foam, corrugated dividers, paper, etc.).

SHIPMENTS TO THE UNITED STATES AND INTERNATIONAL DESTINATIONS. When requesting the service, you must include the dimensions of each box, envelope, and package (length x width x height), along with the weight. Islandwide may, at its discretion, verify the dimensions and weights of your order. If a discrepancy is found, you agree that Islandwide may adjust and charge for the difference in weight and/or dimensions. The weight of each package will be rounded to the nearest whole unit (e.g., 11.5 lbs. will be rounded to 12 lbs.). PLEASE REFER TO THE LIST OF PROHIBITED ITEMS FOR SHIPMENTS TO THE UNITED STATES AND INTERNATIONAL DESTINATIONS AT THE END OF THIS DOCUMENT.

SHIPPING COVERAGE. The maximum shipping coverage is $100.00 per envelope, box, or package, provided that it complies with the packaging conditions outlined in the “Packaging Requirements” clause and is not one of the items mentioned in the “Sensitive Items Excluded from Shipping Coverage” clause or prohibited from being shipped to the United States and/or internationally. Under no circumstances are we responsible for losses and their potential consequences, including but not limited to loss of income or revenue, even if we were aware such a loss might occur. If the shipment requires higher coverage for contents or to cover additional risks, including but not limited to failure to deliver or delivery delays, it is your responsibility to obtain the necessary and/or required additional coverage at your expense. Coverage will be limited to the product's cost (not its sale price) and up to the established limit.

SENSITIVE ITEMS EXCLUDED FROM SHIPPING COVERAGE Claims will be denied for shipments that, under the following parameters, include:
Cash or its equivalents (stamps, certificates of value, etc.); artwork, bonds, coins, fur coats, precious stones (cut or uncut), industrial diamonds, precious metals of any kind or form; important documents highly sensitive to delivery or pickup time; negotiable instruments; processed and unprocessed film; perishable goods such as fruit baskets or other food items; laboratory reagents or any product with a shelf life of less than 48 hours; lightbulbs, glass, ceramics, or porcelain; electronic equipment and/or its accessories.

THIRD-PARTY SERVICES AND CONTENT Islandwide reserves the right to utilize third parties to support the Services and/or shipments to the United States or international destinations. The Services may be made available or accessed through third parties (including advertisements) that Islandwide neither controls nor is responsible for. Each user’s access to the Services via their preferred device or provider is subject to the terms established by such provider.

CLAIMS You agree to submit any claims as soon as possible and no later than fifteen (15) calendar days after the pickup service was performed. Any claim submitted after fifteen (15) calendar days will be automatically denied.

LIMITATIONS You may not use the Services or access them in any manner except as expressly permitted by Islandwide. This includes extracting data from any part of the Services, unduly impairing the operation and/or functionality of any aspect of the Services, attempting to gain unauthorized access to or compromise any aspect of the Services, their systems, or related networks.
9. ACCESS AND USE. To use the Services, you must register for and maintain an active User Service Account with a valid username and password (“Account”). Account registration requires providing certain personal information, such as your name, address, mobile phone number, and at least one valid payment method. You agree to maintain accurate, complete, and up-to-date information in your Account. Failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access or use the Services. You are responsible for all activity under your Account and agree to maintain the security and confidentiality of your Account username and password at all times.
10. Access to Services and Ownership. Subject to compliance with these Terms, Islandwide grants you access to and use of its websites, Applications, and information related to the specific Services you have utilized. Islandwide reserves the right to restrict access and usage without prior notice. The Services and all rights therein remain the property of Islandwide or its licensors.
11. Compliance with Laws and Identity Verification. You agree to comply with all applicable laws when accessing or using the Services and may only do so for lawful purposes (e.g., no transportation of illegal or hazardous materials). In certain cases, you may be required to provide proof of identity or another form of identity verification to access or use the Services, and you agree that access or use may be denied if you fail to provide proof of identity or verification.
12. Data Network and Device Requirements. You are responsible for obtaining the necessary data network access to use the Services. Your mobile network’s data and messaging fees may apply if you access or use the Services from a device. You are responsible for acquiring and updating the compatible hardware or devices necessary to access and use the Services and Applications and any updates thereto. Islandwide does not guarantee that the Services, or any part thereof, will function on any particular hardware or device. Additionally, the Services may be subject to malfunctions and delays inherent to the use of the Internet and electronic communications.
13. PAYMENT METHOD. Islandwide will process charges and payments using the payment method registered in your Account, after which you will receive an email receipt. If the primary payment method associated with your Account is found to be expired, invalid, or otherwise unchargeable, the Service will not be processed. Charges paid by you are final and non-refundable, unless Islandwide determines otherwise.
14. Service Charges and Promotional Offers. Islandwide reserves the right to establish, eliminate, and/or revise Service Charges at any time. Islandwide may offer certain users promotional offers and discounts that may result in different amounts being charged for the same or similar services or products obtained through the use of the Services. You agree that such promotional offers and discounts, unless also made available to you, have no bearing on your use of the Services or the Charges applied to you.

Applicable Penalties for Service Cancellation:
You may choose to cancel your Service request at any time prior to the commencement of such Services, in which case a cancellation fee will be charged. Applicable charges are as follows:

Penalties on Pickup Services:

For cancellation prior to service provision: 25% of the cost.

For a failed pickup attempt: 50% of the cost, and the Service is canceled.

Delivery attempts: A maximum of two (2) delivery attempts per box.

Return of package to the recipient: 100% of the cost of the requested Service will apply.

Return Due to Breach of Terms and Conditions:

Return of the box due to non-compliance with Terms and Conditions: 100% of the Service cost applies.

Changes in Information:

Islandwide reserves the right to apply charges for modifications to the sender and/or recipient information. Such charges, if any, will be notified at the time the User requests such service.

INDEMNIFICATION:
The User agrees to indemnify and hold harmless Islandwide and its affiliates, officers, directors, employees, and agents from any and all claims, demands, losses, liabilities, and expenses (including attorney's fees), arising from or related to:

Your use of the Services;

Your breach or violation of any of these Terms;

The use of your content as a User; or
-
Your violation of the rights of any third party, including third-party providers.

LIST OF PROHIBITED ITEMS FOR SHIPMENT TO THE UNITED STATES AND INTERNATIONALLY
Items circulated under ATA Carnet and all temporary export and import shipments; items circulated under FCR, FCT, and CAD (Cash Against Documents); shipments with inherent defects that, by their nature, may stain, harm, or damage individuals, goods, or equipment; items whose transport is prohibited by law in the country of origin, transit, or destination (e.g., ivory). Items subject to specific consumption taxes (such as alcoholic beverages) or requiring special provisions, safety precautions, or permits.
In compliance with applicable laws, certain items may only be transported under prescribed conditions, and certain items are prohibited from air transport (e.g., liquids in glass containers).
It is the sender's responsibility to comply with applicable regulations or government legislation in each country. Shipments are subject to inspection and potential delays by customs or other government authorities.
We will not transport any items prohibited by the laws or regulations of any national, federal, state, regional, or local government in the countries of origin or destination, or that may violate any applicable export, import, or other regulations, or endanger the safety of our employees, agents, subcontractors, or modes of transportation.
We will not transport any shipment prohibited by national, federal, state, provincial, regional, or local laws or regulations of the country of origin or destination.
Important: It is the sender's responsibility to ensure that a shipment complies with all applicable national, federal, state, provincial, regional, or local laws and regulations governing the shipment.
Examples of prohibited items include but are not limited to:

Animal skins (non-domesticated)

Items of exceptional value (e.g., works of art, antiques, precious stones, gold, and silver)

Hazardous items/materials (as per IATA standards for Express and Expedited shipments and ADR standards for Standard shipments)

Ammunition
-
Lithium batteries
-
Furs
-
Ivory and ivory products
-
Live animals
-
Currency and negotiable items
-
Perishable goods
-
Plants
-
Pornographic material
-
Seeds
-
Tobacco and tobacco products
-
Unaccompanied luggage (except through MBE Centers to certain countries)

Watches valued over USD 500 or the local currency equivalent per package

Alcoholic beverages

Perishable goods

Tobacco and tobacco products

Dangerous goods

GOVERNING LAW AND JURISDICTION
These Terms are governed by and shall be interpreted in accordance with the laws of Puerto Rico. The parties agree that any claim or legal action shall be brought under the jurisdiction of Puerto Rico and the competence of the Court of First Instance.
